Membership Policies
In order to ensure that all our members experience a safe and enjoyable workout environment, we have established the following policies and guidelines. Please read and observe these guidelines. We may amend or add to these policies at any time.
Proper Conduct: Our goal is to uphold a safe workout environment. We expect proper, respectful conduct on the premises at all time. We do not permit disrespectful conduct toward our members, guests, employees, volunteers or property but not limited to vulgar, stalking, indecent offensive, violent, hostile, threatening, profane, indecent, aggressive, harassing, fraudulent or any other inappropriate conduct or communications
Any member or guest not employed by or contracted by Diamond Athletic Club as a personal trainer is prohibited from engaging in Personal Training, Private Coaching, Team Coaching, or any related activity in our club. Diamond Athletic Club reserves the right, in its sole and absolute discretion, to determine whether any act violates this prohibition and will terminate your membership.
Solicitation: Unless authorized by Diamond Athletic Club, you may not solicit-whether in person or in writing-any members, guests or team members on the premises or during off premises events, including but not limited to solicitations for political or religious purposes, media interviews, business opportunities, or competitive products or services.
The use of cell phones in the cardiovascular and strength training areas, the group exercise studio, and the locker rooms is strictly prohibited. (Cameras and other image capturing devices are strictly prohibited in all areas of the facility.) No photographic equipment of any kind is allowed in the gym without prior permission/ approval from Diamond Athletic Club. This includes the use of cell phones to take photographs.
Checking In and Membership Key Tags
Please scan your key tag each time you enter the club. This improves security by distinguishing you from nonmembers. Key tags may not be loaned to another person. Allowing someone else to use your key tag will result in immediate termination of your membership. Unfortunately, one strike and you’re out.
A shirt and shorts or sweatpants, and closed-toe athletic shoes must be worn at all times in the fitness and exercise areas. Jeans, work boots, and other nonathletic attire are not permitted in the fitness/exercise areas. For your protection, shoes must be worn at all times in the workout areas. Shoes must cover your entire foot. (i.e.: no sandals.) No jeans, belt buckles or loose, dangling jewelry items can be worn in the workout area. (These items may damage the equipment or cause injury to you.) Tops must be worn while working out. Sweatshirts, tee shirts, long-sleeved workout shirts are all acceptable tops. Workout shorts must be long enough to cover your buttocks at all times. This includes times that you’re bending, stretching, running, etc.
We welcome guests at DAC. There is a $15.00 guest fee per guest. All guests will need to show a photo ID and sign our release form.
Smoke-Free drug free Environment
Diamond Athletic Club is a smoke free business. Smoking or the use of other tobacco products is strictly prohibited inside Diamond Athletic Club. This restriction includes, but is not limited to, cigarettes, pipes, cigars, snuff, chewing tobacco, vaping devices, and any other form of illegal substance. No Alcohol, Drugs, or Smoking: You cannot engage in any activity at Diamond Athletic Club while under the influence of illegal drugs or alcohol. Diamond Athletic Club does not permit smoking, alcohol, or illegal drugs, including steroids, in our facility.
All Diamond Athletic Club memberships may be canceled under terms agreed upon and outlined on the Membership Agreement.
Diamond Athletic Club cancellation policy allows members to cancel their memberships according to the following:
Early Termination – In addition to the required notice period an Early Termination Fee will apply
Medical Cancellation – Immediate cancellation upon receipt of approved medical documents. Fees may apply.
Moving Cancellations – Receipt of approved relocation documentation is required.
Members may initiate the cancellation in person at club location or by sending a cancellation request by Certified Mail to the club.
The Annual Fee is used to invest in our programs, equipment and facilities to ensure you’re getting the best value for your membership, it is charged each year.
No solicitation by members or guests is permitted in the facility.
No weapons of any kind are permitted in Diamond Athletic Club.
Please remember to bring your key card each time you visit the gym. Please remember that your key card is your own and allowing anyone else to use it may result in immediate termination of your membership. There is a $20 replacement fee for lost cards.
No gym bags are allowed on the gym floor. All bags must be placed in a locker or left outside of the gym. Lockers are available for daily use. Bring your own lock and remember to take it with you when you leave. The club reserves the right to remove locks that are left overnight and assumes no responsibility for the contents of the lockers. We expect proper etiquette in our locker rooms. You may not spit, sleep, or engage in any sexual conduct in our locker rooms. You may not use an electronic devices equipped with a camera in our locker rooms.
Physical Examination: We strongly encourage that you have a complete physical examination prior to beginning any new exercise or nutrition program.
Club closure or Access Restrictions: We reserve the right to close or restrict access, without advance notice, to any area of or the entire club or premise for any reason, including but not limited to closures or restrictions related to construction, remodeling, repair, or maintenance (whether planned or unplanned) or for health or safety reasons, including but not limited to weather, natural disasters, power outages, and medical issues. Your obligation to pay membership dues is not dependent upon usage, availability or access to the club and premises.
Animals: You may not bring any animal on the premises unless it is a service animal performing its duties in the care of a person who requires its assistance or is an on-duty law enforcement animal (“exempt animals”) All exempt animals must be licensed, vaccinated and identification tags, must remain leashed or caged and under a non-Diamond Athletic Club responsible person’s control at all times and must be removed immediately if is causes a disturbance, interrupts the work of others or posse a health or safety risk to those who are exposed to it. The animal’s owner must promptly remove animal waste and is liable for any damage caused by the animal.
Damage to Club: You may not damage the club in any way, including but not limited any damage to, or theft of, exercise equipment, towels, supplies or other club property, such as balls, breaking lights, breaking mirrors, etc. If you or a guest damages the club, you must pay for it.
Opening Doors For the safety and security of everyone in this gym, never open the doors for anyone, even if they have a key tag with them. If their key tag is not working, there is probably a valid reason
Free Weights Please rack your weights when you are finished with them. Your fellow members and the staff will appreciate your cooperation. Some individuals can not lift the heavier plates off the equipment.
Cleaning Equipment Please clean equipment after use. The spray bottles are filled with Barbicide spray. Everyone will appreciate it if you wipe down your hand holds and seat/backrest after you are finished using the equipment.
Equipment and Cardiovascular Training Areas:
- Please be courteous at all times. You must turn off, return or replace equipment to its original condition when you are not using it, even temporarily
- Profanity is not allowed in the gyms.
- EVERYONE MUST CHANGE THEIR SHOES TO CLEAN GYM SHOES (if you do not change your shoes, you will be asked to leave)
- Do not attempt to repair or adjust any equipment that has malfunctioned.
- Outside equipment and accessories are not allowed.
- Please report any equipment problems to the staff immediately.
- Rack all weights and dumbbells after each use.
- Dropping or slamming down of weights will not be tolerated.
- Always use a spotter when attempting maximum weight.
- Collars and clips are to be used for “free bar” lifting.
- Keep hands and feet away from all moving parts and weight stacks.
- Screaming during lifting is a safety issue for all members and is not allowed.
- Please do not use chalk on any equipment in our club.
- Bottled plastic drink containers are allowed anywhere in the club. Glass bottles are not allowed.
DUES PAYMENTS: We collect monthly membership dues typically on the first or fifteenth of every month or at an additional date designated by you for certain products or serves by electronic fund transfer from the designed bank account or credit or debit card on file for you membership (EFT Account) If we are unable to successfully draft payments from you EFT Account when due, we will continue to attempt collection thereafter. I understand that Diamond Athletic Club may use services made available by card issuers who automatically update my card information and prevents disruptions due to account changes, such as an expired card or reissued card. I may opt-out of these services at any time by contacting my club. We are not responsible for overdraft fees. We do not issue regular monthly invoices. To establish your membership, you must provide an EFT Account. In special circumstances, however, you may avoid a forthcoming monthly dues electronic funds transfer by providing an alternate method of payment to the club at least three business days prior to the last day of the month. To change your designated dues-paying account, please see management. Dues are subject to change by Diamond Athletic Club at any time without notice unless otherwise required by law. In the event of a change in any amount charged, Diamond Athletic Club may provide any notice required by law by regular mail or by email to the address(es) associated with the membership.
Continued Membership Means You Agree to Pay Fees. You have the opportunity to cancel your membership for any reason pursuant to your General Terms Agreement. Your continued membership with Diamond Athletic Club constitutes your agreement to pay Diamond Athletic Club fees, including specifically its fees for late and or invalid payments
Late or Non-Payments. You may be charged fees related to late or non-payments if for any reason we do not receive payment for our goods or services by the due date or you pay less than the full amount due for our goods and services. Late Fee. YOU WILL BE CHARGED A $20 LATE FEE ON ANY PAYMENT AMOUNT (E.G., MONTHLY DUES, FEES OR OTHER CHARGES) ASSESSED IN ANY SINGLE MONTH THAT HAS NOT BEEN PAID IN FULL AFTER 15 DAYS FROM THE DUE DATE.
WITH RESPECT TO YOUR MONTHLY DUES PAYMENT DUE ON THE 1st or 15th OF EACH MONTH , WE WILL CHARGE A $20 LATE FEE EACH MONTH IF WE DO NOT RECEIVE THAT MONTH’S DUES FROM YOUR EFT ACCOUNT FOR THREE (3) MONTHS WHILE YOUR MEMBERSHIP REMAINS IN EFFECT, AFTER WHICH YOUR MEMBERSHIP WILL BE TERMINATED FOR NONPAYMENT. Late Fees Are Not Considered Interest or Penalties. We do not anticipate that you will fail to pay your monthly dues, fees and other charges on a timely basis, and we do not extend credit to members or other customers. We sell goods and services, and expect payment for those goods and services before or when we deliver or perform them, including payment on the first or fifteenth of any monthly service period or on any other date on which payments are due. Any fees or other charges due to late payment or nonpayment are liquidated damages intended to be a reasonable advance estimate of our costs resulting from late payments and non-payments. These costs are difficult to calculate or to predict when we set such fees or other charges, including our current $10 late fee, because we cannot know in advance (1) whether you will pay for our goods or services on a timely basis, if ever; (2) when you will actually pay if you do pay late; and (3) what costs we will incur because of your late payment or non-payment.
Invalid Payments. We accept various means of payment for our goods and services, including payment by check for certain goods and services. WITH RESPECT TO PAYMENT BY CHECK, IF A CHECK IS DISHONORED FOR INSUFFICIENT FUNDS OR ANY OTHER REASON, YOU WILL BE CHARGED A $35 FEE FOR SUBMISSION OF AN INVALID PAYMENT INSTRUMENT as provided in the Fee Schedule. IF YOU ARE A MEMBER, WE WILL ADD THE AMOUNT OF THE DISHONORED CHECK PLUS THE $35 FEE TO YOUR MEMBERSHIP ACCOUNT BALANCE, WHICH AMOUNT WE WILL COLLECT FROM YOUR EFT ACCOUNT.
Right to Implement or Change Fees. We reserve the right to implement or change fees or other charges at any time, unless otherwise required by law. We may provide any notice required by law by regular mail or by email to the address(es) associated with the membership.
Membership. A primary or partner member may terminate the membership (or any member may remove or terminate himself or herself from a membership) for any reason upon advance written notice to Diamond Athletic Club as provided in our membership contract with you. To provide written notice of termination, you must complete a termination request or send a letter request via certified mail (return receipt requested) to the club. We do not accept termination requests by phone, email, fax or online.
Termination within First 3 Days of Membership. Upon written notice of termination, you may terminate your membership within 3 days of its activation, provided you have not previously cancelled a membership with Diamond Athletic Club. If we receive your written notice within 3 days of activation of your membership, we will refund a portion your paid Membership Dues. Except as provided herein, we will not refund any products or services purchased by or provided as part of a membership package to you or any other member on your membership.
To terminate a membership, you must provide two weeks advance written notice to Diamond Athletic Club in accordance with your General Terms Agreement.
You may provide written notice of termination in person at the club; by certified mail return receipt requested to Diamond Athletic Club. If you do not provide timely advance written notice, you must continue to pay monthly membership dues and will continue to have center access.
Refund Methods Unless otherwise required by law, we will issue refunds only to the payor as follows:
Credit Card. Payments made via credit card will be refunded by means of a Diamond Athletic Club Gift Card.
Cash or Check. Payments made via cash, check or bank withdrawal will be refunded by means of a Diamond Athletic Club Gift Card.
EFT from Bank Account. Payments made via electronic fund transfer from a bank account (EFT or ACH) may be refunded by means of a Diamond Gift Card.
Gift Cards are non-refundable.
If any member or guest violates any of the Policies or Rules, Diamond Athletic Club will ask that person to stop or leave. A member’s violation of any of the Policies or Rules may also cause Diamond Athletic Club, in its sole discretion, to terminate that person’s membership and/or other agreements.
Diamond Athletic Club staff watches the video logs each day to see who is entering the gym. Do not bring a non-member into this gym to work out without prior permission from a DAC staff member. Bringing a non-member into this gym without prior consent to work out, will result in a $20.00 fee for first offense then immediate termination of your membership with no refund and a $50.00 fine imposed on the account used for monthly membership billing.
In the event that a member fails to follow these rules and any other rules and/or regulations set by the club, Diamond Athletic Club reserves the right to cancel any membership without advance notice or refund of payment(s) made or cancellation of any future payments due.
